Temporary visas limit your stay in Canada
Only immigration visas allow people to stay in Canada indefinitely after arrival. All other visas, including study and work permits, allow only for temporary stay in Canada.
Whether you are coming to Canada as a guest, tourist, student or worker, you only have a limited period of authorized stay in the country. Guests and tourists are usually given a maximum stay of 6 months, while foreign workers and students typically have longer stay authorized by their work or study permits.
Apply for an extension to prolong your stay in Canada
If you came to Canada with a temporary visa and would like to extend the period of your stay, submitting an extension of stay application in advance can help you to accomplish this.
While an application to extend stay in Canada is in process, you don't have to worry about your status in Canada — it is deemed valid until a decision in the application is made.
It is recommended that you submit the application at least 30 days before your authorized period of stay ends. However, in some situations it may be advisable to apply for extension at a later date.
Overstaying can have serious consequences
If you remain in Canada after your authorized period of stay expires, you then become an illegal foreign national in Canada. This can have serious consequences, especially if you plan to visit Canada again in the future.
If the Canadian authorities were to uncover your current illegal status, they can and will issue a removal order, which can ultimately lead to deportation and denial of future entry into Canada.
Legal status can be restored after overstaying
In the event someone remains in Canada beyond the authorized period, it is possible to restore his or her legal status without any consequences.
By submitting the appropriate application (e.g. as a temporary visitor or worker) within a limited time can regain legal status. One will need to apply for a Restoration of Status within 90 days since the expiration of their authorized stay in Canada. They will also have to meet all the requirements and provide a number of supporting documents to qualify for an approval.
An extension of stay can be done without leaving Canada
In majority of cases, you can extend your stay in Canada without leaving the country. It’s nothing more than an urban legend that the authorized period of stay can only be extended by leaving and re-entering Canada.
If the extension request is not approved before your authorized stay has expired then you should consider leaving the country and re-entering another time or you could stay and take your chances in applying for restoration of legal status.
Extension procedures may vary
An extension of stay for a regular visitor is mostly straightforward, while a similar procedure for a foreign worker and student vary, and is dependent on their particular situation.
Additionally, these individuals must meet certain requirements to have his/her foreign student or foreign worker status extended. They should also demonstrate that during their authorized stay, they complied with the stay conditions.
